PinkChat — Terms of Use

1. Eligibility and Access

1.1 Age Requirements

PinkChat is strictly for adults. You must be at least 18 years old to use the Service. If applicable law in your jurisdiction requires you to be older to lawfully use PinkChat without parental consent, that higher age will apply. By using PinkChat, you represent and warrant that you meet this minimum age requirement and have the legal capacity to enter into these Terms.

1.2 Global Compliance

These Terms apply to all users globally. You are responsible for ensuring that your use of PinkChat complies with all applicable laws and regulations in your specific location.

1.3 Additional Policies

Your use of PinkChat is also governed by our Privacy Policy and our Child Safety Policy. Where relevant, certain features may be subject to additional guidelines. In the event of any conflict between these Terms and feature-specific guidelines, the feature-specific guidelines will prevail for that specific service.

2. Your Account and Device

2.1 Account Security

To use PinkChat, you may register via a third-party account (e.g., Google, Facebook) or use a visitor login. We strongly recommend linking a third-party account; visitor accounts are temporary, and you may permanently lose access to your data, connections, and virtual items if you switch devices or log out.

Your account is personal to you. You may not sell, gift, or transfer your account to anyone else. You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. 2.2 Device Access and Permissions

To provide features like video chat and media sharing, PinkChat requires access to certain device capabilities (e.g., camera, microphone, local storage). By using these features, you grant us permission to access these components in accordance with your device settings and our Privacy Policy. You are responsible for any mobile, data, or internet fees incurred while using PinkChat.

3. Community Conduct and Safety

PinkChat is built on respect and connection. We maintain a strict policy regarding user behavior and User-Generated Content (UGC). We do not tolerate abuse, illegality, or harm in any form.

3.1 Prohibited Content and Conduct

To ensure a safe environment, you agree that you will not post, share, transmit, or engage in any conduct that involves:

• Sexually Explicit Content: Pornography, explicit sexual acts, or highly suggestive content.
• Hate Speech & Discrimination: Content that promotes violence, incites hatred, or discriminates against individuals or groups based on race, ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, or gender identity.
• Bullying & Harassment: Harassing, bullying, threatening, doxxing (sharing private information), or repeatedly targeting any user against their will.
• Violence & Self-Harm: Depictions of gratuitous violence, promotion of dangerous organizations (e.g., terrorist groups), or content that encourages, promotes, or provides instructions on self-harm or suicide.
• Illegal Activities & Fraud: Engaging in scams, fraudulent activities, unauthorized sale of goods/services, or promoting illegal acts.
• Impersonation: Impersonating other individuals, creating fake accounts, or misrepresenting your affiliation with a person or entity.
• Technical Abuse: Using automated scripts, bots, or scrapers; reverse engineering PinkChat's source code; or interfering with the platform's security and performance (e.g., spreading malware or spam).

3.2 UGC Moderation, Reporting, and Blocking

We empower our community to maintain a safe, green, and welcoming space. PinkChat provides prominent and easily accessible built-in tools across the platform—including user profiles, matching pages, and chat interfaces—for all users to control their experience and report violations:

• In-App Reporting: Through simple on-screen actions, you can immediately report violating users, inappropriate behavior, or objectionable profile content to our moderation team.
• Blocking & Shielding: You can block any user at any time. Blocking will instantly prevent them from interacting with you, viewing your profile, or sending you further messages.
• Hybrid Moderation System: We employ a robust content moderation strategy combining advanced automated filtering tools with a dedicated human moderation team to proactively screen, identify, and block violating information.
• Enforcement & Timeframes: We take all user reports seriously. We are committed to processing reports and verifying flagged content within a reasonable timeframe. Upon verification of a violation, we will enforce penalties ranging from temporary suspension to permanent banning of the offending account, depending on the severity of the offense.

3.3 Child Safety: Zero Tolerance

PinkChat is strictly an adult-only platform and is absolutely not available to minors. We maintain a strict, zero-tolerance policy against child sexual abuse material (CSAM) and the exploitation, sexualization, or mere presence of minors on our platform.

• Age Verification & Detection: Users are subject to an age verification process prior to using the app. Furthermore, our automated moderation tools are designed to detect the physical presence or likeness of minors in user-generated content (e.g., photos or videos).
• Immediate Action: If minor-related content, or the presence of an underage user, is detected by our tools or reported by the community, we will take immediate action to remove the content and permanently ban the associated accounts without prior notice.
• CSAM Enforcement: You may not, under any circumstances, create, share, request, or store content that depicts, implies, or encourages the sexualization of minors. We aggressively report all identified CSAM and offending users to the National Center for Missing & Exploited Children (NCMEC) and applicable global law enforcement authorities. 4. Communications

4.1 Service Communications

By creating and maintaining a PinkChat account, you agree to receive service-related communications from us that are necessary for the operation of your account. These include account verification, password resets, security alerts, policy updates, and other transactional messages. You cannot opt out of these communications while your account is active.

4.2 Marketing Communications

Where permitted by applicable law and based on an appropriate legal basis, we may send marketing and promotional communications through one or more channels, including email and, as available in your region, in-app notifications, push notifications, and SMS/text messages. These communications are subject to your preferences and any consent requirements that apply.

You may opt out of marketing communications at any time using the channel-specific method provided in the message (for example, an "Unsubscribe" link in marketing emails) or by contacting us at help@pinkchat.app.

If we send promotional SMS/text messages in the future or in regions where SMS marketing is available, we will provide opt-out instructions in the SMS message and you can opt out by following those instructions or by contacting help@pinkchat.app.

Opting out of marketing communications will not affect service-related communications necessary to operate your account.

5. User Content

5.1 Your Ownership and Our License

You retain all ownership rights to the text, photos, videos, and other materials you upload or share on PinkChat ("Your Content").

However, by submitting Your Content, you grant PinkChat a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, reproduce, modify, and distribute Your Content solely for the purposes of operating, developing, and improving the Service.

5.2 Content Restrictions

You are solely responsible for Your Content. You may not upload content that:

• Is sexually explicit, pornographic, or excessively violent;
• Promotes hate speech, discrimination, or self-harm;
• Infringes upon the intellectual property or privacy rights of any third party.

We reserve the right (but have no obligation) to review, moderate, remove, or restrict access to any content that we determine violates these Terms or harms the community, without prior notice.

6. Subscriptions, Purchases, and Refunds

6.1 In-App Purchases

You may purchase virtual currency, premium features, or subscriptions via the Google Play Store. All purchases are processed by Google and are subject to Google Play's terms of service and billing policies.

6.2 No Refunds

All purchases of virtual items and subscriptions are final and non-refundable. We cannot issue refunds directly. If you experience a billing issue, you must submit a refund request directly through the Google Play Store, subject to Google's refund policies. You will not receive cash compensation for unused virtual items, even if your account is suspended or terminated.

6.3 Pricing

We reserve the right to modify the pricing of our virtual items and subscriptions at any time. If you have an active subscription, price changes will take effect at the start of the next billing cycle, and you will be notified in advance.

7. Intellectual Property

7.1 PinkChat's Rights

All intellectual property rights in PinkChat—including software, design, logos, and branding—are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not use our branding, trademarks, or proprietary materials without our express written consent.

7.2 Copyright Infringement

We respect the intellectual property rights of others. If you believe your copyright or trademark is being infringed by content on PinkChat, please submit a detailed takedown notice to us at help@pinkchat.app.

8. Disclaimers and Limitations of Liability

8.1 "As Is" Disclaimer

To the maximum extent permitted by law, PinkChat is provided on an "AS IS" and "AS AVAILABLE" basis. We explicitly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or free from errors or viruses.

8.2 Limitation of Liability

To the fullest extent permitted by applicable law, PinkChat, its affiliates, and its directors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Service.

In no event shall our total aggregate liability for all claims related to these Terms exceed the greater of: (i) the amount you paid to us in the twelve (12) months preceding the claim, or (ii) fifty US dollars ($50.00 USD).

8.3 Third-Party Services

PinkChat may contain links to third-party websites or services. We do not endorse and are not responsible for the content, privacy practices, or actions of any third parties. Your interactions with them are solely at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless PinkChat and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (i) your use or misuse of the Service; (ii) Your Content; or (iii) your violation of these Terms or applicable laws.

10. Termination

We reserve the right to suspend or terminate your account and your access to PinkChat at our sole discretion, at any time, and without prior notice, if we believe you have violated these Terms or pose a risk to the platform or other users.

You may terminate these Terms at any time by deleting your account and removing the application from your device. Upon termination, the licenses granted to you by PinkChat will cease immediately, but clauses intended to survive termination (including IP, Liability Limitations, and Governing Law) will remain in effect.

11. General Provisions

• Entire Agreement These Terms constitute the entire agreement between you and us regarding PinkChat.
• Severability If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver Our failure to enforce any right or provision will not be considered a waiver of those rights.
• Updates We may modify these Terms occasionally. Material changes will be communicated via the app or website. Continued use of PinkChat after changes take effect constitutes your acceptance of the revised Terms.

12. Regional Privacy Disclosures

12.1 GDPR for EEA/UK Users

We process personal data based on contractual necessity, legitimate interests, consent, and legal obligations. You hold rights to access, rectify, erase, restrict, port your data, and withdraw consent. Data may be transferred outside the EEA/UK using standard legal safeguards. 12.2 CCPA for California Residents

We collect identifiers, demographic data, location data, internet activity, and media for service operation. We do not sell personal information. California residents have the right to request disclosure, deletion, and opt-out of data sharing without discrimination. 13. Account and Data Deletion

We respect your right to control your personal data. You may delete your PinkChat account and associated data at any time using either of the following methods:

• In-App Deletion: You can delete your account directly within the PinkChat app by navigating to the Settings menu and selecting the account deletion option.
• Email Request: If you no longer have access to the app, you may submit a formal deletion request by sending an email to our support team at help@pinkchat.app. Please include your account details in the email to help us verify your identity.

Upon initiating the in-app deletion process or receiving your email request, we will process the deletion of your account and personal information within the timeframes required by applicable law, subject to any necessary legal data retention obligations (such as cooperating with law enforcement or maintaining security blocklists).
